Terms of Service

These Terms of Service ("Terms") govern your use of the app, website and services provided by Tranquilix Pty Ltd ("we", "us", or "our"), including Breeze and any related services (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
1. Scope of the Terms
These Terms apply to all access to and use of the Service. If you are under 13, you may not use the Service. Users between 13 and 18 may only use the Service with parental or guardian consent.
2. Medical Disclaimer
Breeze provides guided breathing exercises for personal wellness only. We are not a healthcare provider and nothing in the Service constitutes medical advice. If you experience dizziness, discomfort or any adverse effects, stop immediately and consult a qualified health professional.
3. Use of the Service
You agree not to:
- Violate any applicable law or regulation
- Use another person's account without permission
- Interfere with or disrupt the integrity of the Service
- Use bots, scripts or scrapers without our permission
- Harass, harm or abuse others, including through social and co-breathing features
4. Accounts and Security
You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. You may not share your account with others. Please notify us promptly if you suspect any unauthorised use.
5. Social Features
Breeze allows you to connect with friends and participate in shared breathing sessions. You may only use these features to connect with people you know personally, and you must use them respectfully and lawfully. We reserve the right to remove connections or suspend accounts that misuse social features.
6. Subscriptions and Payments
We offer free and paid subscription tiers. Paid subscriptions renew automatically unless cancelled before the renewal date through your app store settings. Nothing in these Terms limits any rights you may have under the Australian Consumer Law.
7. Third-Party Services
The Service may contain links or integrations with third-party services not owned or controlled by us. We are not responsible for those services and do not endorse them. Your use of any third-party service is at your own risk.
8. Intellectual Property
The Service, including its content, design, software and branding, is owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable licence to use the Service for personal, non-commercial purposes. You retain ownership of any content you submit to the Service, but you grant us a limited licence to use it solely to provide and improve the Service. You warrant that content you submit does not infringe any third-party rights.
9. Indemnification
You agree to indemnify and hold harmless Tranquilix Pty Ltd and its directors, employees and partners from any claims, liabilities or costs (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.
10. Termination
We may suspend or terminate your access at any time if we reasonably believe you have violated these Terms or applicable law. You may stop using the Service at any time. On termination, your licence ends immediately and you must delete any downloaded materials.
11. Changes to the Service
We may modify, suspend or discontinue any part of the Service at any time for reasons including maintenance, security or operational needs.
12. Disclaimer
The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied. Nothing in these Terms excludes any guarantee that cannot be excluded under the Australian Consumer Law.
13. Limitation of Liability
To the fullest extent permitted by law, Tranquilix Pty Ltd and its directors, employees and partners will not be liable for any indirect, incidental, special or consequential damages arising out of your use of the Service.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the date at the top. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
15. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes will be resolved by the competent courts of that jurisdiction.
